Social housing and domestic abuse: the abuser leaves, not the survivor

On 20 October the government tabled amendments to the Social Housing Bill: perpetrators, not survivors, would be made to leave a social home, and survivors would not have to prove the abuse twice. What changes, where protective orders are not yet available, and why this is not law yet.

The Ministry of Housing, Communities and Local Government announced on the evening of 20 October 2026 that it is tabling amendments to the Social Housing Bill. The main one deals with a situation in which a domestic abuse survivor has until now lost their safety and their home at the same time.

What exactly is the government proposing?

That the perpetrator leaves the social home, not the survivor. Under a joint tenancy both tenants stand equal before the landlord, and in practice the person who leaves is the one who goes to a refuge.

The amendments would strengthen protections for joint tenancies against an abusive partner, so that the perpetrator can be made to go. They would also bolster the discretionary grounds for possession: the existence of a relevant protective order would be enough for a court to consider taking action.

Third, and for many the most important: survivors would not have to prove the abuse again where a protection order already exists. Today that case is often made twice — once in court, once to the housing service.

Housing Secretary Angela Rayner put the point plainly: no survivor should have to choose between staying with their abuser and losing their home.

What is a protective order, and does it work everywhere?

This is the detail the press release does not spell out, and it matters. Orders differ. A non-molestation order and an occupation order apply across England and Wales, and the second one decides who may stay in a home or return to it.

A domestic abuse protection order is newer and is not yet available everywhere. According to GOV.UK you can apply only if you live in Hartlepool, Middlesbrough, Redcar and Cleveland, Stockton-on-Tees, Greater Manchester, the London boroughs of Croydon, Bromley or Sutton, or North Wales. There are no court fees to apply.

So for part of the country the question "do you have a protective order" still comes down to geography.

Is this already law?

No, and that matters. The Social Housing Bill was introduced to Parliament on 14 May 2026, and the measures announced on 20 October are amendments to be tabled as the Bill passes through its Commons stages. The government has not given commencement dates.

Until the Bill passes, the existing rules apply: approaching the council for housing help, refuges, and protective orders as they stand today.

What else is in the package?

The amendments go beyond abuse. The notification period for social housing disposals is extended from 4 to 8 weeks, giving councils and housing associations more time to buy such a home and keep it in the social sector. Notifications will also state the type of rent the home was previously let at.

Councils will be able to designate eligible rural areas as exempt from Right to Buy themselves, against set criteria, instead of applying formally to government. The wider package is expected to keep an additional 18,000 homes in the social sector over the next decade.

Two new duties target homelessness: a Duty to Collaborate, requiring key public bodies to identify households at risk and act together, and a Duty to Offer, requiring private registered providers to offer suitable accommodation to households referred by a local housing authority unless they have good reason not to. Local connection rules are to be disapplied for armed forces veterans, who could seek help from any council in England.

One more date: from April 2027 Tenant Management Organisations come under Freedom of Information rules, so residents can request information on repairs, estate management and rent collection.

The figures behind the announcement: £39 billion of investment in council, social and affordable housing, and £442 million to tackle rough sleeping. The National Housing Federation, which supports the Bill's objectives, noted that almost 180,000 children are growing up in temporary accommodation.

Where to turn right now

If you are in immediate danger, call 999. From a mobile, if you cannot speak, press 55 after the call connects and you will be transferred to the police.

The free 24-hour line in England is Refuge's National Domestic Abuse Helpline, 0808 2000 247. For male victims across the UK there is the Men's Advice Line, 0808 801 0327. Victim Support's line for anyone affected by crime is 08 08 16 89 111.

The Bill is still going through Parliament, but the right to ask the council for housing help exists today — and it is worth asking before you have to leave.
