Probation periods in the UK: what they do not suspend

UK law has no concept of a probation period — it is a contract term. Your contract exists from the moment you accept the offer, even verbally. Here is what applies from day one, what arrives after a month, and what after two years.

"You're on a three-month probation" sounds as routine in a British office as anywhere else. The difference is that UK law has no such concept at all. A probation period here is an agreement between you and your employer, not a separate legal regime with reduced rights.

Does a probation period exist in UK law?

No. GOV.UK covers probation periods inside the section on employment contracts — as one of the contract's terms, nothing more. Which means everything written about yours was written by your employer, not by Parliament.

One more thing that surprises new arrivals: the contract exists the moment you accept the job offer. Not when you sign a document, not on your first day. An employment contract does not have to be written down at all.

Which rights apply from day one, and which are earned?

Some rights do not depend on any probation period. Your employer must show a valid reason for dismissal and act reasonably: be consistent — not dismiss you for something other staff are allowed to do — and investigate fully before deciding. A part-time or fixed-term worker cannot be treated less favourably than a full-time or permanent one.

Other rights switch on with service. You can demand written reasons for dismissal once you have completed two years; the employer must supply them within 14 days of your request. The exception is dismissal during Statutory Maternity Leave: there the written statement is given regardless of length of service and without being asked.

How long before notice rights apply?

The key figure is one month, and it cuts both ways.

Once you have been in the job more than a month, you must give at least a week's notice. Your contract may require it in writing; if it does and you resign verbally, you may be in breach and your employer could take you to court. The notice period usually runs from the day after you hand it in.

The employer is bound by the same clock on a longer scale: at least one week if you have been employed between one month and two years, one week for each year between two and twelve years, and 12 weeks after twelve years. A contract may offer more than the statutory minimum, never less.

Immediate dismissal without notice is possible but exceptional — violence at work, for example.

What "failing probation" actually means

It means one thing: the employer has decided to part ways. Legally they must still honour notice and show the decision was reasonable. What you may lack is two years' service, which is when the right to written reasons arrives.

So the practical advice is simple: get everything in writing from day one. The terms, the length of any probation, who extends it and on what grounds. A verbal contract is binding, but only what is recorded can be proved at a tribunal.

If you change your mind about resigning

A resignation handed in during a row can sometimes be withdrawn — tell your employer immediately. They are not obliged to accept the withdrawal; that is their choice. Another reason not to resign in the heat of the moment.

Acas, the state conciliation service, gives free advice on notice periods and dismissal rights, and the helpline costs nothing.
