Gift Aid: how one tick adds a quarter for the charity — and when it becomes your debt

A charity claims 25p for every £1 you give, and higher-rate taxpayers can claim part of it back. But the four-times-your-tax rule means HMRC can ask you for the difference.

The Gift Aid box on a donation form looks like a formality. It is actually two separate flows of money: one adds to what the charity receives, the other can come back to you. And there is a condition that can turn the box into a debt to HMRC.

What does Gift Aid give the charity?

Charities and community amateur sports clubs can claim an extra 25p for every £1 you give, at no cost to you. Donate £100 and the charity receives £125.

What do you have to sign?

A Gift Aid declaration. The charity provides the form, and it must have an HMRC charity reference number. You need a separate declaration for each charity, but one declaration can cover future donations and donations made in the previous 4 years.

The key condition: you must have paid enough tax

Donations qualify only if they are no more than four times the tax you paid in that tax year, 6 April to 5 April. That tax can be Income Tax or Capital Gains Tax.

Only sign a declaration if you have paid enough tax to cover what the charity will reclaim. If a charity reclaims more than you paid, HMRC may ask you to pay the difference. And if you stop paying enough tax, you must tell the charities you support.

What does the donor get?

If you pay tax at a higher rate, you can claim back the difference between the tax you paid on the donation and the tax the charity reclaimed. This applies in Scotland too.

The official example: on a £100 donation, a 40% taxpayer can reclaim £25 — that is 20% of £125.

How do you claim it?

Two ways: through your Self Assessment tax return, or by contacting HMRC and asking them to amend your tax code.

A separate case: Payroll Giving

If you give through Payroll Giving, higher-rate relief works differently: you simply do not pay the difference between the higher and basic rates on the amount donated.

What if you donate assets rather than money?

This is a separate and less familiar route. You do not pay tax on land, property or shares donated to a charity — covering both Income Tax and Capital Gains Tax. It also applies to selling such assets to a charity for less than market value: the sale is treated as a gift.

One wrinkle on CGT: if you sell for more than the asset cost you but less than market value, tax may arise, and the gain is worked out from the amount the charity actually receives rather than the market value.

Income Tax relief works like this: the value of the donation is deducted from your total taxable income for the tax year in which the gift was made. Self Assessment filers enter it in the charitable giving section; others contact HMRC and receive either a refund or a tax code adjustment. Donations to community amateur sports clubs do not qualify for Income Tax relief.

On paperwork: keep records showing the gift or sale and that the charity accepted it. If a charity asks you to sell the asset on its behalf, relief still applies, but you need records of both the gift and the request — otherwise Capital Gains Tax may be due.

In short

The box is worth ticking: the charity gets a quarter more and it costs you nothing. But tick it only if you pay tax, and keep the four-times rule in mind. Higher-rate taxpayers should claim the rest separately — otherwise that money never arrives.
