Where to complain about benefits
If a benefits service caused excessive delay, failed to follow procedure or treated you poorly, you may be able to take the complaint to the Independent Case Examiner after receiving the organisation's final response. The normal deadline is six months.

Received a final response to a complaint about benefits, a pension or child maintenance, but the service problem remains unresolved? Your next step may be the Independent Case Examiner, a public service that reviews complaints about maladministration by specified government bodies and contractors.
Official guidance updated on 23 October 2026 sets an important deadline: you should normally approach the examiner within six months of the organisation's final response. The service is free.
Who you can complain about
In Great Britain, the examiner covers the Department for Work and Pensions, Jobcentre Plus, the Pension Service, Disability Services, the Child Maintenance Service and contracted providers, including firms carrying out health assessments or employment programmes.
For Northern Ireland residents, specified benefit, pension and child-maintenance complaints involving the Department for Communities are also covered.
What it can investigate
- failure to follow proper procedures;
- excessive delays;
- poor customer service.
Important: the examiner cannot decide whether you are entitled to a benefit or change the amount awarded. Challenges to a benefit decision normally use mandatory reconsideration and then an appeal. This service examines how your case was handled.
What to do first
- Complete the organisation's internal complaints process.
- Obtain its final response, which should signpost you to the Independent Case Examiner.
- Keep a copy. If the response was given by phone, record the date, organisation, staff member's name and a summary of what was said.
- Within six months, use the contact details on the official guidance page. Include your name, address, National Insurance number, phone or email, complaint details, preferred contact method and any accessibility adjustments you need.
You may use a representative, but the complainant must provide written consent.
What happens next
The service says it will tell you within two weeks whether it can accept the complaint. That is an initial acceptance decision, not the deadline for completing an investigation. If the complaint is upheld, recommendations may include an apology, corrective action or a consolatory payment; there is no fixed award.

The examiner does not manage your ongoing benefit, pension or child-maintenance case.
It cannot investigate disputes about the law or benefit entitlement, government policy, staff employment matters, issues already before a court, or matters for the data regulator or an ombudsman. Starting legal proceedings may prevent the investigation from continuing.
