Protect Universal Credit at Christmas
When December wages are paid early because a business closes for Christmas, employers should report the normal contractual payday to HMRC. The wrong date can reduce an employee’s Universal Credit for an assessment period.
Thanks for £1HM Revenue and Customs reminded employers of the special reporting rule for early December wages on 21 October. When regular pay is transferred early because of Christmas or a workplace closure, the Full Payment Submission should show the employee’s normal or contractual payday. This helps prevent distortion of the employee’s Universal Credit calculation.
What must an employer do?
If regular December pay is brought forward only because of the festive timetable, use the normal contractual date in the payment date field of the Full Payment Submission. Send the report on or before that normal date.
HMRC’s example: an employee receives the money on 19 December, but their normal payday is 31 December. The employer reports 31 December and submits the report no later than that date. Paying early does not create a second salary payment or change the contractual payday.
Why can Universal Credit fall?
Universal Credit is calculated over monthly assessment periods using earnings information supplied by employers through HMRC. If early December pay is reported against the bank transfer date, two monthly salaries may appear in one assessment period. The award for that period could fall or become zero even though the employee’s annual income has not increased.
Universal Credit rules allow a monthly payment to be reallocated where two payments fall into one assessment period, helping maintain a regular pattern. Correct employer reporting can prevent the dispute and delay from arising.
What should an employee check?
- If the company pays early for Christmas, ask payroll which date will be reported. It should be the normal contractual payday, not the date of the early bank transfer.
- Keep the payslip, a bank statement showing receipt and evidence of the normal payday.
- Check the December and January Universal Credit statements. If two monthly salaries appear in one assessment period, report the disputed earnings through the online journal and ask for the calculation to be checked.
For England, Scotland and Wales, see the GOV.UK earnings guidance. In Northern Ireland, nidirect guidance says to message the online account or contact a work coach if two payments fall in one assessment period; payslips and bank statements may be requested.
Important: this rule concerns regular wages brought forward because of the festive timetable. A bonus, additional payment or genuine change to the normal payday may be treated differently.
